These Terms of Service ("Terms") govern your access to and use of the Velone website, email sending platform and APIs (the "Service"). By creating an account or using the Service, you agree to these Terms. If you are using the Service on behalf of an organisation, you represent that you are authorised to bind that organisation.

01 The Service

Velone provides an API and platform for sending transactional and permission-based marketing email, together with related deliverability, logging and analytics features. We may improve, change or discontinue features over time. We will give reasonable notice of material adverse changes where practicable.

02 Accounts

You must provide accurate registration information and keep it up to date. You are responsible for safeguarding your credentials and API keys and for all activity under your account. Notify us promptly at support@velone.in of any unauthorised use. You must be at least the age of majority in your jurisdiction to use the Service.

03 Acceptable use

Your use of the Service is subject to our Acceptable Use Policy (the "AUP"), which is incorporated into these Terms. In particular, you may only send to recipients who have given you permission, and you may not send spam, unlawful, deceptive or harmful content. Violations may result in immediate suspension.

04 Your responsibilities

• You are solely responsible for the content of the email you send and for having a lawful basis (such as recipient consent) to send it.
• You must honour unsubscribe requests promptly and keep your recipient lists clean.
• You must comply with all applicable laws, including anti-spam, data-protection and consumer-protection laws.
• You must properly authenticate your sending domains (SPF, DKIM, DMARC) as instructed.

05 Fees & billing

Paid plans are billed in advance on a recurring basis according to the plan you select. Usage above plan limits may incur additional charges. Fees are non-refundable except where required by law. We may change pricing with prior notice; changes take effect at your next billing cycle. You are responsible for applicable taxes.

06 Suspension & termination

You may cancel at any time. We may suspend or terminate your access if you breach these Terms or the AUP, if your sending threatens platform reputation or security, if required by law, or for non-payment. Where the situation allows, we will give notice and an opportunity to cure. We may suspend immediately and without notice in cases of suspected spam, fraud, or abuse. On termination, your right to use the Service ends and we may delete your data after a reasonable period.

07 Availability

We work to keep the Service available and reliable, but the Service is provided on an "as available" basis. Uptime commitments, if any, are stated in a separate service-level agreement available on eligible plans. We are not liable for downtime caused by factors outside our reasonable control, including recipient mail-server behaviour.

08 Intellectual property

Velone and its licensors own all rights in the Service, including software, documentation and trademarks. We grant you a limited, non-exclusive, non-transferable right to use the Service during your subscription. You retain all rights in your content; you grant us the limited rights needed to transmit and process it to provide the Service.

09 Data protection

Our handling of personal data is described in our Privacy Policy. Where we process personal data on your behalf, we do so as your processor and, where required, under a Data Processing Addendum.

10 Disclaimers

To the maximum extent permitted by law, the Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that every message will be delivered, as delivery depends on recipient mail servers and factors beyond our control.

11 Limitation of liability

To the maximum extent permitted by law, neither party will be liable for indirect, incidental, special, consequential or punitive damages, or for lost profits or revenues. Our total aggregate liability arising out of or relating to the Service will not exceed the amount you paid to us for the Service in the twelve months before the event giving rise to the claim.

12 Governing law & contact

These Terms are governed by the laws of India, without regard to conflict-of-law rules, and the courts located in India will have jurisdiction, unless mandatory local law provides otherwise. We may update these Terms from time to time; material changes will be posted here with a new "last updated" date, and continued use after changes constitutes acceptance.
